您好!

有關您於102年3月12日以電子郵件函詢 擔任私人家教老 師是否合法乙節,茲說明如下:

一、依就業服務法(以下簡稱本法)第43條規定:「除本法另有規定外,外國人未經雇主申請許可,不得在中華民國境內工 作。」,第46條第1項 規定:「雇主聘僱外國人在中華民國境內從事之工作,除本法另有規定外,以下列各款為限:一、專門性或技術性之工作。二、華僑或外 國人經政府核准投資或設立事業之主管。三、下列學校教師:(一) 公立或經立案之私立大專以上校院或外國僑民學校之教師。(二) 公立或已立案之 私立高級中等以下學校之合格外國語文課程教師。(三) 公立或已立案私立實驗高級中等學校雙語部或雙語學校之學科教師。四、依補習 教育法立案之短期補習班之專任外國語文教師。五、運動教練及運動員。六、宗教、藝術及演藝工作。七、商船、工作船及其他經交通部 特許船舶之船員。八、海洋漁撈工作。九、家庭幫傭。十、為因應國家重要建設工程或經濟社會發展需要,經中央主管機關指定之工作。 十一、其他因工作性質特殊,國內缺乏該項人才,在業務上確有聘僱外國人從事工作之必要,經中央主管機關專案核定者。」,第68條第1項規定:「違 反‧‧‧第43條‧‧‧規定者,處新臺幣3萬元以上15萬元以下罰 鍰。」,同條第3項規定:「違反第43條 規定之外國人,應即令其出國,不得再於中華民國境內工作。」

二、依上開規定,外國人欲在我國境內工作,需經雇 主申請許可,始得在臺工作,另目前外國人在我國境內從事之工作,除本法另有規定外,以本法第46條第1項各款為限,故 您所提擔任私人家教老 師乙節,因本會並未開放此工作項目,若您有從事私人家教老師之情事,已違反本法第43條規定,依本法第68條 規定,除處新臺幣3萬元以上15萬 元以下罰鍰外,並應限令出國,不得再於中華民國境內工作。

Why the surprise to see something written in the offical language of the country they are living in.

Problem is too many outsiders coming over here expecting to be spoon feed in their own language.

What? Serious posting? Ok. Just this once. The article doesn't specifically mention the topic of online degrees, but seems to only discuss private tutors without work permits.

擔任私人家教老 師是否合法 = Are private tutors legal or not?

外國人未經雇主申請許可,不得在中華民國境內工 作 = foreigners who have not applied for work permits may not work in the republic of China.

However, despite this article not discussing this particular topic, it is common knowledge that online or distance degrees do not qualify for work permits for language teaching in Taiwan. Ironically, the rule has more to do with locals than foreigners. The rule exists mainly to prevent locals from opting out of the Taiwanese university system, by disqualifying foreign distance degrees for local professions. Many universities would see dramatic drops in enrollment (more than already experienced) if students could simply take an online program from universities like Cambridge in the comfort of their homes, as opposed to competing tooth-and-nail for a spot at TaiDa. To protect the uncompetitive local system, the government stipulates that the only recognized foreign degrees, from their point of view, are the ones done in-residence actually at the universities. This means only the rich, who can afford to live and study abroad, can bypass the Taiwan system. It also means foreigners are made subject to this rule as well. There is a possible loophole, however, for foreigners. Online degrees offered by universities with physical campuses may not incate that a degree was completed by distance education, as opposed to on-campus. For a Taiwanese, the government can catch these by looking at passport records, but they can't do this with people from abroad (unless you completed the program while living in Taiwan).

Cambridge has online degrees? lol wat.

Most online shitty degrees are from places like university of phoenix or devry institute. i doubt a taiwanese person could drop 50k a year on these shitty degrees.

Does you current university offer distance education? Most universities do.

Harvard's online course wrote: Harvard recently asked its alumni to volunteer their time as "online mentors" and "discussion group managers" for an online course.
