Sandman you always claim to know things then write that you don't know what the penalties for the crimes being discussed are.

You also make claims as to the ROC Military Officer who stayed in the UK. Again your claims are incorrect and without merit.

She's not. She's in an illegal immigrant detention centre. The UK has received no asylum application from her. She'll be deported after the Christmas holidays and apparently Taiwanese officials will be on hand to make sure she returns to Taiwan -- obviously, (despite the shitty half-arsed reporting from the Taiwanese so-called "reporters") the Brits don't give a fuck where she goes, as long as she leaves the UK. I imagine she'd prefer to go to ... pretty much anywhere but Taiwan. I'm pretty sure she's not aware that she can tell the Taiwanese to fuck off. But there you go. The mouth-breathers here are describing it as "repatriation." Bunch of fucking ignorant, know-nothing clowns. Standard Taiwanese reporting, in other words.

She hasn't tried. There is no record of any such application. But other than that, its pretty much perfect Taiwanese reporting. Chabuduo. There's a woman. From Taiwan. In trouble. In the UK. There's a Taiwanese rep in London spouting hot air out of his stupid arse. That's the full extent.

Whereas the news and Ms Yeh have confirmed she did apply for political asylum in the UK.

More likely there's a guy from the UK living in Taiwan spouting hot air out of his stupid arse.

I'll take the word of practically ANYBODY over that of the people stitching up Zain, though. DESPITE my utter conviction of the integrity of the people involved in his prosecution.

You're talking out of your arse. Zain got railroaded, plain and simple. You know it, the cops know it, the courts know it.

Hmm...Yes, Sandman's M/O throughout the Dean trial and afterwards has been to deride the police, the courts, the Taiwanese media, Taiwanese people themselves, and pretty much anyone who has dared to suggest that Dean committed a crime. Notice, however, that he stays away from the facts in the case? I'm guessing the Scots courts will be denounced as corrupt by Sandy when Dean gets sent back to serve the sentence he illegally fled. He'll no doubt blame those "mouth-breathing" Taiwanese for exerting influence over the Scots legal system. He'll blame all and sundry-- just not his pal, salt of the earth fella that he surely must be.

ZD's lawyers have already attached the court for abuse of power mishandling extradition cases and not being professional. Of course not granting bail for ZD also makes them upset.

But there is nothing breaching ZD's human rights.

Would you take the word of the Scottish and European Courts who may say that Zain Deans Taiwan trials meet their standards?

Looks like ZD gets to stay in prison for another month in Scotland. He must be getting used to prison life there by now.

Better a prison in Scotland than a prison on Taiwan.

http://www.chinapost.com.tw/taiwan/nati ... ily-of.htm

TAIPEI, Taiwan -- When British fugitive Zain Dean fled Taiwan two years ago, Lin Su-gui fears that he took something she may never get back — a chance to find closure.
“He never said sorry,” said Lin, the aunt and surrogate mother of Huang Chun-teh, the 32-year-old deliveryman whom Dean was convicted of killing in a hit-and-run. “From the first trial to the second, he kept saying it wasn't his fault.”

Lin, still haunted by her choice to let Huang borrow her scooter on the night of the fatal crash in 2010, is hoping that Dean's extradition hearing in Edinburgh yesterday has brought her family one step closer to justice and maybe a chance to hear an apology.

Remorse, an ever-growing area of research among criminologists, have a profound healing effect on victims and their communities, according to Lennon Chang, a professor at City University of Hong Kong researching Taiwan's restorative justice pilot programs. “Our criminal justice system focuses too much on the criminals.”

Acts of contrition, however, have always posed a notoriously difficult legal tightrope for defendants, as they can often be incriminating, but especially in Taiwan, where some believe the specter of martial law still linger in courtroom gavels.

Under Taiwan's criminal code, a refusal to repent for a crime, even prior to conviction, can lead to maximum sentences, raising questions about due process. “If a defendant is innocent, why does he or she apologize to the victim?” Chang said.

Dean Advised Not to Apologize

Like most defendants who plead not guilty to a charge, Dean was advised by his attorney Billy Chen not to apologize, “because he would in effect be admitting his guilt,” said human rights activist Linda Gail Arrigo, who believes Dean suffered an unfair trial and that the public was hoodwinked by corrupt cops and “xenophobic” media.

Although the High Court did acknowledge Dean's “verbal” remorse in its guilty verdict in 2012, the judges tacked on two years and seven months to his sentence largely for a “lack of penitence.”

“This is the imperial mentality; if you don't show remorse, if you don't beg the court, they're going to give you a stiffer penalty — this goes back to the martial-law days,” said Arrigo, who had witnessed steely dissidents, such as Kaohsiung Mayor Chen Chu, recant under the law while fighting for the island's democratization in the 1970s.

Victim's Family

Still, the Huang family's wish for an apology draws from a much simpler well — a belief that there was enough evidence to convict Dean.

In their eyes, the day they learned he fled Taiwan confirmed both his guilt and indifference to their prolonged “mental torture” over an unresolved case that has found no justice and no healing. “My bother's been dead for four years now, and not even an apology?” said Huang's sister, Jia-huei, to The China Post. “If you didn't do it, why did you run away?”

I don't know why anyone wants me to apologize for anything I've done.

I'm innocent. I ran away because I am innocent. I am prepared for others to go to jail in my stead to show just how innocent I am.

Any volunteers? Chris Churcher has done time for me. Who is next please? Running away and leaving others in jail does not make me a coward with no concsience.

They plan on keeping me in jail a long time it's just not fair. The UK courts have rejected my claims, and said even just for DUI there is a jail penalty alone that warrents jail time. No bail for me. It's obvious the Scottish courts have abused their power over my extradition, and for not giving me bail.

Good old Zain Dean, when now given chance on witness stand accuses all and sundry of corruption, incompetence, etc etc but when asked to name such currupt persons in his case he has no answer.

Can't answer for the fact he was so drunk can't remember anything but blames lack of video to clear his name.

Such is the life on those on the lam now in the correct place he should be in. Prison. No bail for you son.

Your wild claims are unfounded without merit and yet again you can't tell the truth. No police officers at Da An who were ever indicted for anything worked your traffic accident case. Now you claim court tranlsations are incorrect even though you admit you can't read Chinese. You claim the judges were asleep at your trial.

Unlike you who was drunk asleep at the wheel of your car and killed a young man after your alcohol fueled binge drinking late night session.

Prosecutors asked Lin Keying on behalf of the ROC government, he alleged corruption judge what was the name? The police suspected of corruption who were prosecuted? In this regard, on the witness stand Lin Keying totally no answer.

Of course you cannot name any corrupt police or corrupt judges in your trials. There aren't any and never were any. Pure fabrication on your part to save your sorry arse from jail time. You left another to rot in jail in your bid for freedom. What sort of person does that to a friend?

Yes I have been given my day in court in Scotland.

The only truth I have been able to give to the Scottish court was that I was drunk driving my car on the night of the accident.

So far all my following efforts have failed to succeed in court.

1. Bail. I have no idea why they consider me a flight risk as I have only changed my name to flee other criminal convictions in Taiwan before, then bought another's passport to flee Taiwan over my conviction for killing a guy when shitfaced. It's not like I am asking the judge to sell me his passport ( yet).

2. My lawyers failed in claiming that Taiwan courts have no rights to try British Citizens for crimes committed in Taiwan. How dare a country I lived in for most of my adult life have the right to try me for anything? Taiwan should not have the right to try British Citizens for crimes they commit in Taiwan. I claimed before that Taiwan violated the Geneva Convention. But I fucked up; that was only for prisoners of war.

3. We failed to prove that Taiwan is not a territory and that it has no standing in the world. However the truth of the matter is, I thought they would let me go, and that Taiwan would not have the power or the reach to come get me, as advised by my good friends from the peanut gallery in Taiwan. I taunted the Taiwan government by calling them up and saying catch me if you can. You can imagine my surprise when the coppers came and arrested me.

4. We accused the Scottish court and judge of abuse of power and of being incompetent in even hearing my extradition case. How dare they accept the agreement signed between Taiwan and the UK for my extradition. I am sure this violates my human rights under the Geneva Convention, WTO trade rules, animal cruelty laws, Domino's Pizza 30-minute guarantee, 60 minute dry cleaners, The Caramilk secret and, of course, my diplomatic immunity.

5. The lawyers in court asked me to name the police and judges I claim who are corrupt and if I am suing them. Of course I wasn't able to answer that as that is all just bluster and spin doctoring. Just like I wasn't able to answer the Taiwan court in my appeal when the judge asked me if I was not driving at the time of the accident then who was.
I also claimed the Taiwan judge was asleep during my trial.

6. I claimed that the Taiwan rep's court transcripts are not translated by an internationally recognized organization so are not valid. When the Scottish Judge asked me if I could read Chinese I had to admit that I can't.

7. I claimed that my trials in Taiwan do not meet the UK or European standards for my human rights, which were violated by Taiwan. The judge rejected this and stated that my DUI conviction alone would merit jail time if the offence had been committed in the UK.

Now they are going to have video evidence given to the court. No doubt the people giving evidence against me will be allowed to collude and conspire to get me extradited.

I am going to ask Ironlady to come to court to do the translations and Sandman the mouthbreather to be the judge. I want Headhoncho11 the clueless, Big Fat Chief aka the drug repository, Jimipresley the heroin addict and alcoholic, Maoman ( DEAD IS DEAD ) the fence sitter, and several other supporters to be my (im)partial jury. Most important is I need Danger Mouse to be my investigative police detective.

Can somebody please start a facebook group to raise funds for Moaman, so he can pay back his personal debts then buy a ticket to come visit me? I'm afraid he wont have enough money for his MRT pass.

I want a court of my peers who will acquit me no matter what evidence shows that I must have been the one driving at the time of the accident.
However, there is one thing I do still believe in, and that is Chris and my GF who are on the whole decent, well meaning, industrious, and friendly. I will miss their generosity of spirit, and their willingness to take it up the arse and do jail time for me. 16 November 1971 is my birthday please do send me presents

I'm so glad you want me as a peer. After all I was able to write complete misinformation on the flob before regarding your case in support of you.

Latest news, and, of course, this isn't "official", that is it hasn't appeared in any of the papers, you know, like the one where the guy's being specifically labeled as having commited an act for which he has yet to be tried, but latest news is they're taking forever to go to trial because the already circumstantial evidence is so weak, no Prosecutor will touch the case, it being pretty apparent it'll get thrown out the first day.
A forensic expert has identified numerous places where the security cam tapes from the KTV were clearly tampered with, and not very skillfully, either.
Upon cursory examination, none of the KTV employee's stories matched, and were consistently contradicted by their cell phone records.
The driver kid's deposition was wildly inconsistent and apparently collapsed upon even basic follow up questioning.
More than 5 Prosecutors have passed on going to trial, and it's apparently been hot-potatoed down to like the most junior staff, like under-30s, and they don't even want it.
As always, not stating guilt or otherwise, but there cetainly isn't, as some of us discussed previously, anything even remotely like a case here.

As for dozing through the incident, I think ZD indicated that the kid pretty much had to shake him awake upon arriving near his home.

the chief wrote:
What do you know about due process? All the evidence supporting the charges against Mr. Dean is circumstantial, at best.
And a large portion of what there is has been proven to have been tampered with, anyway.
There was no evidence placing Dean at the scene of the crime.
There was no evidence that he was driving his car that night, to the contrary, in fact.
There certainly wasn't any evidence that he was driving drunk, that's why he wasn't charged with driving drunk (a "confession" here is meaningless in the absence of any other evidence; imagine if you walked into the police station tomorrow afternoon and said you wanted to confess to driving drunk the night before, and were turning yourself in, how far do you think you'd get? :loco: ).

As has been mentioned here before, the complete absence of substantiative evidence to support Mr. Dean's indictment is the reason that, after all this time, they still haven't been able to set a court date.

Any DA who prosecutes this case is going to end up losing, it's clear, and none of them want that.

FWIW, however, nobody with any (real) influence on the outcome of this case will give a monkey's how many foreigners support Mr. Dean, nor how vehement that support may be.

It looks like the judges have reached the end of their patience and earlier this week required the prosecutors to present their body of evidence.
The prosecution's sole exhibit is a video segment showing Mr. Dean getting into the passenger side of his car and someone else, dressed as an employee, getting in the driver's side. Apparently the video isn't clear enough to identify the employee.
That is the full extent of the prosecution's evidence.
The judge has made the disclosure public, an unusual move.
More than likely to avoid criticism when he throws the case out.

An interesting side note is that the owner of the KTV, who had earlier sworn under oath that he had gone home long before the time when Mr. Dean left, can be clearly seen on the video right there all along.
